Note to client: FatPipe personnel are very flexible and understanding of individual needs, below rules and regulations are in place mainly to protect FatPipe and its long list of client base members from the unscrupulous and dishonest that tends to worm their way in and out of reputable establishments. FatPipe is one of the two OLDEST reputable hosting companies to date, and will be here until death do us part. We will work with any reasonable request as long as there is honesty and mutual respect for both parties.

Customer Information
The customer agrees to provide accurate information when they register. Any falsification of registration information with the intent to deceive FatPipe will render all obligations FatPipe has towards the customer null and void. Any change of contact information must be updated by the customer via contact with support and/or a FatPipe sales representative.

Use of Services offered by FatPipe
Game servers and the FTP sites associated with them are to be used only for the hosting of the game and making connections to it to play. All uploaded files are to be used by the server software. The customer agrees not to commit any actions which will lower the performance of the game server, the other game servers on the machine, or the machine itself. The customer agrees not to alter any of the settings that affect bandwidth, or CPU usage of the game server. These settings include, but are not limited to: sys_ticrate, sv_maxupdaterate, sv_maxrate, netservermaxtickrate or any other variables that affects the server's performance.. Any customer who violates/alters these settings and conditions will be subject to a penalty fee of $30 and/or non-refundable termination of service.

Websites offered by FatPipe are never to be used to offer FTP file downloads. FatPipe can offer separate FTP sites for such downloads if needed. The customer agrees not to commit any actions that use excessive bandwidth, or which may cause excessive CPU usage.

Voice Servers are to be used specifically for the purpose of voice communication, and no other purpose.

While in/using machines, servers, or services offered by FatPipe, you may not: Engage in any activities that would cause excessive distress or slander upon any other person; transmit or copy any data that is not owned or licensed by you, is obscene or racially/ethically objectionable.

Any customer caught attempting to gain additional access to or in any other way abuse FatPipe's servers or equipment will have their service terminated and will not receive a refund. This includes in-game hacks on any of the servers hosted by FatPipe, attempting to gain privileged access to FatPipe's routers, switches, or operating systems. This also includes attempting to gain additional access through FTP, telnet, SSH, or any other means that is not granted to the client by FatPipe, and is grounds for immediate termination of service. The client will be held liable for any damages. In extreme

Circumstances, FatPipe has and will prosecute to the full extent of the laws in the states of Texas , California , Missouri , Illinois , Georgia , Virginia , New York

The maximum amount of Hard Drives space allocated to each game server for custom maps, sounds, and other files is 2 Gigabytes. If there is an overage of this quota, the client will have the option to either delete some files or pay $5 per additional Gygabyte of storage used.

The maximum player slots on a game server may not be altered by the client unless express permission is given by FatPipe. Deviation from that will result in a penalty fee of $30 and/or non-refundable termination of service.

Any game server used by the customer or the customer's guests after the subscription period has expired will be considered a renewal and will result in additional charges.

The standard network rate in our default game server configuration is 8000 (in some games it is set to 10000). This is the maximum speed that we allow our servers to be set to. Adjusting it above this without permission or additional payment will result in an increase in charges.

FatPipe does not allow the use of pingboosters (such as unlag or booster_mm), nor do we allow the use of the TSC for Counter-Strike or StatsMe-rank and top 10-or-15 unless explicitly granted permission. We reserve the right to modify this list of unallowed addons at any time (we will post changes on our website). Any type of BOT (except for Unreal/UT and UT2Kx) will result in a $30 penalty fee and/or non-refundable termination of service. We allow a maximum of 4 bots per each server purchased, and on all Unreal/UT/UT2Kx servers.

Private Servers are to remain private. Setting a private server to public (removing the password) will result in you being billed for a public server. The password for a private server must remain private. It may not be put in the server name, the front (or prominent area) of a website, IRC channel welcome message, etc. If a private server is abused in this way, it will be billed as a public server.


Guarantees of Service offered by FatPipe
Network Uptime: Our ISP's offer us between a 98 and a 99% uptime.
Given lead time between us and our ISPs we are then offering a 97% network uptime to our customers. This means we guarantee the InterNAP/Verio/Worldcom/Peer-1/Level-3/GX networks we connect to, be available 698.4 hours out of 720 hours a month (based on a 30 day month) or no more than 21.6 hours of network downtime a month.

Machine Uptime: FatPipe Reserves the right to have machines down for scheduled maintenance 12 hours a month and unscheduled maintenance 6 hours a month.

For hardware failure we reserve the right to have 24 hours a month for dealing with hardware failure on machines. This includes any downtime for hardware failure on such machines as the web servers and voice servers.

Power Failures: It is extremely unlikely for any of the datacenters our machines are located at to lose power as they have 4 levels of backup. We are, however, reserving the right to suffer power losses for 4 hours a month.

Server Config Related Downtime: FatPipe offers no guarantee of uptime where the configuration of the game server instance itself is the cause of the downtime. We will work diligently to get it running again if such downtime occurs. While we do monitor game servers for uptime, it is the customer's responsibility to report any down server issues to us where the cause is misconfiguration.

Compensation for Downtime: If a game server is down for longer than the time limits specified above the compensation is a 1:1 ratio in days. So if the server is down for 25 hours due to hardware failure we will offer 1 day compensation. To receive 3 days the server would have to be down for over 72 hours, etc.


Billing/Renewal/Cancellation
Activation/Cancellation All server setups are subject to a one time $30 setup fee if client requests termination prior to end of term. At the end of your term you will have 3-to-5 days to make payment for the next term before termination of service occurs.

Cancellation: It is the client’s responsibility to cancel any and all accounts that are generated by client with FatPipe as auto-pay or subscription basis. All client requests via email/phone/IM asking to have FatPipe Staff provide this service, will have to submit written request by midnight, within 72hrs of their billing anniversary date.     

 

All New Accounts billing will be on a subscription/ auto-reoccurring basis unless otherwise arranged by client and sales.

THERE ARE NO EXCEPTIONS; To ensure the low cost of our quality networks and hardware, we cannot afford the luxury of additional accounting tasks and/or wasted tech time in monitoring clients personal billing information/due dates. ALL FatPipe client accounts are strictly setup by the client and any/all arrangements for services is non-transferable nor able to be edited by FatPipe personnel.

Re-activation: Any servers terminated for non-payment and then re-activated will be subject to a $10 charge. re-activation in excess of 7-days will be subject to $20 charge. we will hold all client personnel files 10-to-14days past end of term.

Bounced Checks or Paypal Chargebacks Any bounced checks or Paypal Chargeback for services rendered will be subject to an additional $30 fee.

Credit Card Use You must be 18 years of age to submit a payment on FatPipe's site via credit card. Also, if the name and/or address on the credit card do not match the name and/or address on the customer account with FatPipe the owner of the card must fax us a signed approval allowing us to charge the card.

REFUNDS: FatPipe does not offer refunds for either services rendered or for the unused remainder of a service term. The only instances where monetary compensation will occur is in account credits for any downtime as listed above. All cancellations occur at the end of term.

Unlawful use of services offered by FatPipe will result in immediate account termination with no refunds or warning (IE Warez on your server - any programs found on the server that are not freeware or shareware will be considered warez).

Personal folders found on the server can and will be deleted without notice and a warning will be issued. If any subsequent occurrences are discovered a $30 penalty fee will be incurred, and/or non-refundable termination of service.


Acknowledgements By User
Computer and Network/Internet Faults: You the user acknowledge that computer and network systems are not fault free and there may be times when these systems experience interruptions and downtime (unavailability). FatPipe does not guarantee uninterrupted service though does make compensation for certain types of interruption as listed earlier in this document. The user agrees that he/she/they shall make no claim of breach of contract for any such interruption.

Copyrights/Trademarks: The user acknowledges that all copyrights and trademarks (registered and unregistered), intellectual property, design rights (registered and unregistered), in the website, the machines and the game servers belongs to FatPipe and the user shall not infringe on any of those rights. This includes copying, distribution and/or modification.

The user acknowledges that certain material is supplied under license and that such property rights are owned by the licensor [FatPipe].

Communication: The user acknowledges that they shall not use any unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, racial, sexually oriented, or otherwise objectionable material in communication with FatPipe, post such material on FatPipe forums, or have such material on their servers and or web sites. FatPipe reserves the right to remove any such material it finds objectionable, without notice.


Liability:
IN NO EVENT WILL FatPipe BE LIABLE TO CUSTOMER FOR ANY CONSEQUENTIAL, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL DAMAGES OR ANY LOSS OF PROFIT, REVENUE, DATA OR GOODWILL WHETHER INCURRED OR SUFFERED AS A RESULT OF UNAVAILABILITY OF THE SERVICES, PERFORMANCE, NONPERFORMANCE, NEGLIGENCE, TERMINATION, BREACH OR ACTION OR INACTION UNDER THIS AGREEMENT EVEN IF CLIENT ADVISES FatPipe OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. THE FOREGOING LIMITATION ON LIABILITY, HOWEVER, SHALL NOT RELIEVE FatPipe FROM LIABILITY FOR DIRECT DAMAGES ARISING SOLELY OUT OF FatPipe's GROSS NEGLIGENCE OR WANTON OR WILLFUL MISCONDUCT IN PERFORMANCE OF THE HOSTING SERVICES.


Acceptance of Terms
The user of any FatPipe service agrees to be bound by these terms and services. Failure to accept these terms and services means the user does not have Permission to access
 any services offered by FatPipe and must cease use immediately
.


Miscellaneous:
Lag is not a term directly used or accepted in a technical aspect by FatPipe. View the four elements of what makes up what is typically known as 'lag', below.

Machine Latency is the term often known as ping. The Latency to a server is the time in milliseconds it takes for data to travel to and then back from the machine the server is hosted on. This is the number you would see in a DOS ping.

Server Latency is virtually identical to the Machine Latency, but includes the time it takes for the server to interpret the data and return it to your game client. This is the ping number you see inside of the game.

Packet Loss is when data sent to the game server does not arrive there. Many games have meters to see the level of packet loss to the server. In HL/CS/DOD and Quake3 based games it is known as the NetGraph (Lagometer in MOHAA and MOHAAS). In Unreal/UT based games it is viewable via hitting the F6 Key.

Choke is when the flow of data going to -or- from the server is not allowed to flow as widely (meaning as much data) as it would like to be. In HL this is viewable via the NetGraph. It is not listed in any othe r g ame as choke, but as the number of packets flowing. Choke %99 of the time is percieved as being the server connection or bandwidth malady. Choke can occur from spooling of data in the upline stream or a bad hop, also misconfiguration of the server and/or the client settings being set to uninterperable parameters will cause a choke reading on the Netgraph. Most every instance this issue is a client side problem.
